4. Payment Terms and Conditions
Fees for services will be communicated through a quote, invoice, service package, statement of work, or other written communication. Unless otherwise stated:
- All amounts are in Canadian dollars (CAD);
- Payment is due by the date specified on the invoice or agreement;
- Deposits, retainers, or advance payments may be required before work begins;
- Any taxes, including GST/HST or other applicable taxes, will be added where required by law;
- Late payments may be subject to interest at the maximum rate permitted by law, together with reasonable collection costs;
- We may suspend work or withhold delivery of files until all outstanding amounts are paid in full.
Unless expressly stated otherwise in writing, fees are non-refundable once work has commenced, except where required by applicable law or as provided in these Terms.
You authorize Flatremryt, or its payment processor, to charge your selected payment method for all amounts due under the applicable agreement or invoice.
5. Cancellation and Refund Policy
Cancellation requests must be made in writing to [email protected]. The following rules apply unless a separate written agreement provides otherwise:
- If you cancel a booking or project before work has started, any refund of prepaid amounts, if applicable, will be determined based on the services reserved, administrative costs incurred, and any non-recoverable third-party expenses.
- If cancellation occurs after work has started, you remain responsible for payment for all work completed, time reserved, and expenses incurred up to the date of cancellation.
- Retainers and deposits may be non-refundable to the extent they secure studio time, scheduling, or resource allocation, unless a refund is required by law.
- No refunds will be issued for completed services, delivered files, or approved work, except where required by applicable law.
- If Flatremryt cancels a service due to reasons within our control, we will use commercially reasonable efforts to reschedule or issue a refund for any prepaid amount not yet earned, subject to applicable law and any third-party charges already incurred.
Refund decisions may consider the nature of the work, whether digital deliverables have been provided, and whether custom services were performed specifically for you.
6. Liability Limitations
To the fullest extent permitted by applicable law, Flatremryt and its directors, officers, employees, contractors, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, business opportunities, or anticipated savings, arising out of or related to your use of our website or services.
To the fullest extent permitted by law, Flatremryt’s total aggregate liability for any claim arising out of or relating to the services or these Terms will not exceed the total amount paid by you to Flatremryt for the specific service giving rise to the claim during the three (3) months preceding the event first giving rise to liability, or CAD $500, whichever is greater, except where liability cannot be limited under applicable law.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence where such limitation is prohibited, or any liability that cannot legally be excluded under the laws of Canada or the applicable province.
Our services are provided on an “as is” and “as available” basis, and we do not warrant that the website or services will be uninterrupted, error-free, secure, or free from harmful components.
